Review and Complaint Rights

Except in the case of an objection by a third party direct to the Information Commissioner, the Act provides for two consecutive levels of review:

  • an internal review within this Department, and then
  • an external review by the Information Commissioner

These review provisions will only apply to an initial decision made on or after 1 July 2004.

Review of a decision

An applicant has 30 days, from the date of receipt of the notice of decision, to seek a review of our initial decision.

The Department then has 30 days to review the decision and notify the applicant of the outcome. A review is taken to be refused if the applicant is not notified of a decision within 30 days of the Department accepting the application and application fee (where applicable).
